Well: In Flashpoint, Thomas becomes Batman and Martha is the Joker. When Bruce died in crime alley, she went nuts, and became the Flashpoint Joker. Thomas could kill any other villain he finds, but he just can't kill the woman he once loved. And it could be argued, that Thomas found the regular "Joker" when he was in his red hood guise, and killed him before he ever went into the chemicals, as it's clear he has never had a problem killing other criminals.
